Arbitration

Arbitration in the South Eifel municipality is an important part of local dispute resolution. Arbitrators act as neutral mediators in conflicts and help to ensure that disputes can be resolved without going to court.

Basics of the arbitration system

  • Legal framework: The arbitration system is regulated by the State Arbitration Act and the Arbitration Rules for the State of Rhineland-Palatinate. These legal frameworks set out the legal basis for the activities of arbitrators, including their powers and the procedures they can use.
  • Tasks of the arbitrators: Arbitrators are responsible for mediating in civil disputes. These include, for example, disputes between neighbors, disputes over compensation or smaller civil law claims. They try to find an amicable solution that is acceptable to both parties.
  • Procedure: The arbitration procedure is generally straightforward. The parties can contact the arbitrator, who will then arrange a meeting. In this meeting, both sides have the opportunity to present their point of view. The arbitrator moderates the discussion and tries to work out a solution. If an agreement is reached, this can be recorded in writing.
  • Voluntary work: Arbitrators work on a voluntary basis and often have a wide range of life experience as well as social and communication skills. They are usually well trained and have completed training in mediation or conflict resolution.
  • Advantages of arbitration: The advantages of arbitration are obvious. It is generally cheaper than court proceedings, as there are no high court costs. In addition, the process is often quicker as the arbitrators can offer flexible appointments. Another advantage is the confidentiality of the proceedings, as the discussions are not public.
  • Contact persons: There are specific contact persons in the Verbandsgemeinde Südeifel who provide information about the arbitrators and their activities
